Agent Platform terms of use

These terms apply to the Scale Rule Agent Platform, provided by Scale Rule Consultancy Limited (company number 17406773, 26 Brook Road, Horsham, West Sussex RH12 5FY), trading as Scale Rule Consulting, registered in England and Wales. They sit alongside the written agreement each client signs. Where the two differ, the signed agreement wins.

What the platform does

The platform has two assistants. A client switches on the ones it wants.

  • Enquiries assistant: watches an email inbox the client connects, picks out new enquiries, and drafts replies.
  • Socials assistant: drafts posts for a Facebook Page and linked Instagram account the client connects, publishes the ones the client approves, and shows how each one performed.

Every draft reply and every draft post is held for a named person at the client to approve. Nothing is sent or posted without that approval.

Who may use it

Only businesses that have a signed agreement with Scale Rule, and the people that business names as users and approvers. A client may connect only email and calendar accounts, Facebook Pages and Instagram accounts it owns or is entitled to manage.

The client's responsibilities

  • Approving is a real decision. Drafts are written by software, including AI, and can be wrong, incomplete or badly judged. The approver is responsible for reading each draft before approving it. An approved email or post is the client's own.
  • Lawful use. The client must have a lawful basis for the personal data it handles through the platform, and must have the rights to any words, images or other content it approves for posting. It must not use the platform to send spam, publish unlawful or misleading content, or do anything that breaches the rules of Google, Meta or any other connected service.
  • Keeping access safe. The client keeps its users' sign-ins secure and tells Scale Rule promptly if it thinks an account has been misused.

Scale Rule's responsibilities

  • Run the platform with reasonable skill and care, and keep each client's data separate and secure.
  • Handle personal data only as described in the Agent Platform privacy notice and the client's data processing agreement.
  • Tell the client without undue delay if there is a security incident affecting its data.

Availability

The platform depends on services run by others, including Google and Meta. It may sometimes be unavailable, for planned maintenance or because one of those services is down. When it is unavailable, nothing is sent or posted, and enquiries wait in the inbox as normal.

Disconnecting and ending

A client can disconnect any account at any time, by asking Scale Rule, directly in its Google account, or by removing the platform in Facebook. Disconnecting deletes the access the platform held. When the agreement ends, the client's data is deleted as set out in the privacy notice, unless the client asks for a copy first.

Liability

Nothing in these terms limits liability that cannot be limited by law. Beyond that, liability is as set out in the client's signed agreement.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

Changes

When these terms change, the date changes with them, and clients are told about any material change before it takes effect.
